    Role of Armed Forces Tribunal

  • Abstract :

Armed Forces Tribunal in the administration of military justice in India. It analyzes the jurisdiction, powers, and functions of the Tribunal and evaluates its contribution to protecting the legal rights of service personnel. The study also explores how the Tribunal balances the requirements of military discipline with the principles of natural justice, fairness, and constitutional governance. Particular attention is given to the Tribunal's role in reviewing service matters, court-martial decisions, and disciplinary actions within the armed forces.

The research further assesses the effectiveness of the Tribunal through an examination of judicial decisions, legislative provisions, and practical challenges affecting its functioning. It highlights issues such as delays in appointments, limitations in enforcement of decisions, and concerns regarding access to justice. The study concludes that while the Armed Forces Tribunal has strengthened the military justice system by providing specialized adjudication and enhancing accountability, certain reforms are necessary to improve its efficiency and ensure greater protection of the rights of armed forces personnel. The Tribunal remains a vital institution in promoting justice, discipline, and the rule of law within the armed forces of India.
